These Terms of Service (“Terms”) govern your access to and use of the Kundi platform, website (kundi.ng), mobile application, and related services (collectively, the “Services”), operated by Synthovolt (“we”, “us”, or “our”). By accessing or using the Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to these Terms. If you are using the Services on behalf of a school or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
Kundi provides a cloud-based school management platform that helps schools manage:
- Student records and admissions
- Attendance tracking
- Fees collection and billing
- Examination results and report cards
- Communication with parents
- Staff and role-based access controls
The Services are provided “as is” and “as available”. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.
3. Accounts and Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify us immediately of any unauthorized use of your account.
- Schools are responsible for ensuring that only authorized personnel (admins, teachers, etc.) have access to student data.
4. User Responsibilities
You agree not to:
- Use the Services for any illegal purpose or in violation of any applicable law
- Upload, store, or transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to any part of the Services
- Scrape, copy, or reproduce any part of the Services without permission
- Harass, threaten, or abuse other users
- Misrepresent your identity or affiliation
5. School Data and Responsibility
As a school management platform:
- The school (not Kundi) is the data controller of student and staff data entered into the platform.
- You are responsible for obtaining necessary consents from parents/guardians for processing student data.
- You must comply with the Nigeria Data Protection Act 2023 and other applicable laws regarding children's data.
- We act only as a data processor and will process data strictly in accordance with your instructions.
6. Fees and Payment
- Some features or subscription plans may require payment.
- Fees are non-refundable except as expressly stated.
- Payments are processed through third-party payment providers — we do not store full payment card details.
- We may suspend or terminate access if payments are overdue.
7. Intellectual Property
All rights, title, and interest in the Services (including software, design, text, graphics, logos) are owned by Synthovolt or our licensors.
You are granted a limited, non-exclusive, non-transferable license to use the Services for your school's internal management purposes only, during your active subscription.
8. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms, non-payment, or for any other reason with or without notice.
Upon termination, your right to use the Services ends immediately. We may delete your data after a reasonable period, subject to legal retention obligations.
9. Limitation of Liability
To the maximum extent permitted by law, Synthovolt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.
Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved exclusively in the courts of Abuja, FCT.
11. Changes to Terms
We may update these Terms from time to time. The updated version will be posted here with a revised “Last updated” date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
